These Terms of Use (“Terms”) govern the access or use by you, an individual or entity, from within any country in the world of applications, websites, content, products, and services made available by Bird Hospitality Services Pvt. Ltd. (“BHS”), a company incorporated under Indian Law having its registered office at E–9, Connaught House, Connaught Place, New Delhi – 110001. BHS provides hospitality services and operates luxury hotels under the name and style “The Roseate,” New Delhi located at Samalkha, New Delhi-110037.

This document is an electronic record in terms of the Information Technology Act, 2000 of India and rules thereunder. By accessing the website or clicking on the “I ACCEPT” button, you consent to be bound by these Terms. If you do not accept any of these Terms, please do not use the Site or avail any of the services provided.

Your acceptance of the Terms shall operate as a binding agreement between you and BHS. BHS may terminate or amend these Terms at any time. Supplemental terms may apply to certain services (e.g., promotions or events). In case of a conflict, supplemental terms prevail.

By accepting these Terms, you also accept our Privacy Policy.

1. Services

Services include the use of the BHS website for reservations, marketing, promotional services, and purchasing hospitality services or merchandise.

• You will only use the Service for personal use, not resale or assignment.
• You will not use accounts without proper authorization.
• You will not use the Service for unlawful purposes or attempt to harm it.
• You will comply with applicable laws including the Information Technology Act, 2000.
• You agree that BHS may process, transfer, and store your data outside India, in line with its Privacy Policy.

2. Eligibility

You may use the Services if you are at least 18 years old and legally competent to enter into a contract. If your jurisdiction imposes restrictions, you must comply with them.

3. Registration and Account

You must register with accurate, current, and complete data. You are solely responsible for safeguarding your account credentials. BHS may suspend or terminate your account if fraudulent or false data is provided.

4. Restrictions

• No reproduction, modification, or resale of the Services.
• No reverse engineering, scraping, or unauthorized access attempts.
• No use of BHS intellectual property without authorization.

5. Payment

Services may result in charges that are final and non-refundable (unless otherwise determined by BHS). Any cancellation of services may attract a cancellation fee, displayed at the time of cancellation.

6. Disclaimer

The Services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind. BHS does not guarantee uninterrupted or error-free services.

7. Limitation of Liability

BHS is not liable for indirect, incidental, special, or consequential damages (including lost profits or data) arising from your use of the Services, unless caused by gross negligence or willful misconduct.

8. Indemnity

You agree to indemnify and hold harmless BHS, its officers, directors, and employees from any claims, liabilities, or expenses arising from your use of the Services or breach of these Terms.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of India. The courts of Delhi, India have exclusive jurisdiction over disputes.

10. Intellectual Property

You have no right, title, or interest in BHS’s intellectual property. You may not use its trademarks in a misleading or disparaging manner.

11. General

• No joint venture, partnership, or agency relationship exists between you and BHS.
• These Terms constitute the entire agreement and supersede prior agreements.
• If any provision is invalid, the remainder remains enforceable.
